1. Overview

This website is operated by Fantastic4toys Co, trading as Fantastic4toys (“Fantastic4toys”, “we”, “us” or “our”).

Fantastic4toys provides this website, online store and related information, features and services (collectively, the “Services”) to users and customers subject to these Terms of Service (“Terms”).

By accessing our website, creating an account or placing an order, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy, Shipping Policy and Return and Refund Policy.

Please read these Terms carefully before using the Services. If you do not agree to them, you should not use the Services or place an order.

Nothing in these Terms excludes, limits or restricts any consumer right, guarantee, remedy or liability that cannot lawfully be excluded, limited or restricted.

2. Eligibility and Permitted Use

You must be legally capable of entering into a binding contract in your place of residence to place an order.

You may use the Services only for lawful purposes. You must not use the website or any product purchased from us in violation of applicable law or in a manner that infringes the rights of another person.

You must not transmit malicious code, interfere with the security or operation of the website, access the website through unauthorised automated means, collect other users’ personal information, or use the Services for fraudulent or misleading activity.

We may restrict or terminate access to the Services where we reasonably believe that fraud, unlawful activity, security interference or a material breach of these Terms has occurred.

3. Product Information

We take reasonable care to ensure that product descriptions, photographs, prices, compatibility information and safety information are accurate when published.

Photographs are provided for identification and illustration. Colours and finishes may appear differently depending on lighting, manufacturing variation and the display used to view the website. Minor cosmetic or production variations that do not materially affect a product’s identity, function or safety may occur.

Product compatibility may depend on factors including bicycle model, model year, frame type, gearing, brake configuration and other installed components. References to bicycle models or product compatibility apply only to the configurations expressly described on the relevant product page.

Customers should review the complete product description before ordering and contact us before purchase or installation if compatibility is uncertain.

A general disclaimer elsewhere on the website does not override a specific product description, express warranty or mandatory consumer right.

We may correct product information and discontinue or modify products prospectively. Material changes will not retrospectively alter an order already accepted, except where required for safety, legal compliance or with the customer’s agreement.

4. Aftermarket and Third-Party Products

Some products sold by Fantastic4toys are aftermarket parts produced by independent third-party manufacturers.

Unless expressly stated otherwise, aftermarket products are not manufactured, endorsed, sponsored or approved by Brompton Bicycle Ltd. or any other original bicycle manufacturer. References to third-party names, bicycles and trademarks are used only to identify intended compatibility or application.

Fantastic4toys remains the customer’s point of contact for questions, complaints or safety concerns regarding products purchased directly from us. We may contact the relevant manufacturer, supplier, importer or service provider when investigating or resolving a matter.

5. Orders and Contract Formation

Submitting an order is an offer to purchase the products shown in the order.

An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. Unless applicable law requires otherwise, the contract is accepted when we confirm dispatch or otherwise expressly accept the order.

We may refuse or cancel an order for a reasonable and lawful reason, including:

• payment failure or suspected fraud;

• incorrect pricing or product information;

• insufficient stock;

• inability to deliver to the stated destination;

• export, sanctions or other legal restrictions;

• product safety concerns;

• suspected unauthorised resale; or

• an obvious error affecting the order.

If we cancel an order after receiving payment, we will refund the applicable amount using the original payment method, unless another lawful method is agreed.

Customers must provide complete and accurate billing, delivery and contact information. We are not responsible for avoidable delay or additional cost caused by materially incorrect information supplied by the customer, except to the extent otherwise required by law.

6. Prices, Payment, Taxes and Import Charges

Prices may be changed before an order is accepted. A price change will not affect an order already accepted unless there was an obvious pricing error or the customer agrees to the change.

The currency, product price and shipping charge applicable to an order will be displayed during checkout.

Unless checkout expressly states otherwise, customers ordering internationally may be responsible for import duties, customs charges, taxes, brokerage fees and other government charges imposed by the destination country. These charges are not controlled by Fantastic4toys and may not be included in the amount paid to us.

We will provide any information about additional charges required by applicable law before purchase.

Payment information must be valid and authorised for use by the customer. Payment processing may be provided by Shopify or another independent payment provider and may also be subject to that provider’s terms and privacy practices.

7. Shipping and Delivery

Shipping methods, estimated delivery times, tracking availability and delivery restrictions are described in our Shipping Policy and during checkout where applicable.

Delivery dates are estimates unless we expressly agree to a guaranteed date. International shipments may be delayed by customs processing, security screening, weather, carrier disruption, incorrect delivery information or other events outside our reasonable control.

Nothing in these Terms transfers the risk of loss to a consumer earlier than permitted by applicable law.

Where tracking records a parcel as delivered but the customer cannot locate it, the customer should contact us promptly and also check with household members, neighbours, building management and the local carrier. We will review the available tracking information and provide reasonable assistance with a carrier enquiry.

Customers should inspect delivered parcels and report material shipping damage, missing items or incorrect products promptly. A failure to report immediately does not remove any mandatory legal right.

8. Returns, Cancellations and Refunds

Returns, exchanges, order cancellations and refunds are governed by our Return and Refund Policy, together with any mandatory rights under applicable law.

Our ordinary return period does not limit a customer’s rights concerning:

• defective or unsafe products;

• products materially different from their description;

• incorrect products supplied by us;

• products damaged before delivery; or

• any legal guarantee or remedy that cannot be excluded.

Where applicable law provides a cooling-off or withdrawal right, that right applies regardless of any shorter or less favourable provision in our voluntary return policy.

Returned products must be handled in accordance with the Return and Refund Policy. A product involved in a suspected safety incident should not be returned until appropriate arrangements for evidence preservation, packaging and transport have been agreed.

9. Product Use, Compatibility and Intended Purpose

Customers must use products only for their stated or reasonably intended purpose and in accordance with all applicable instructions and safety warnings.

Customers should confirm that the product is appropriate for their bicycle, configuration, rider requirements and intended type of riding. If compatibility or intended use is uncertain, the customer should contact us before installation or use.

Products must not be used after unauthorised modification or in a manner materially outside their intended application.

Nothing in this section transfers responsibility to the customer for a defect, unsafe condition, misleading description or incompatibility that should reasonably have been identified or disclosed by us or another responsible economic operator.

10. Installation

Certain bicycle components require specialist knowledge, suitable tools, specified tightening torques and correct installation procedures.

Safety-critical components—including pedals, brakes, cranksets, handlebars, stems, wheels, racks, steering components and drivetrain components—must be installed and checked in accordance with the applicable instructions.

Where specialist tools, torque specifications or technical knowledge are required, installation and inspection should be carried out by a qualified bicycle mechanic.

Before riding, the customer or installer should confirm that the component is secure, correctly adjusted, operating normally and free from interference with other parts of the bicycle.

To the extent permitted by applicable law, Fantastic4toys is not responsible for injury, damage or loss to the extent caused by:

• incorrect installation or adjustment;

• failure to tighten a component correctly;

• use of unsuitable tools;

• failure to follow applicable instructions;

• installation on an incompatible bicycle or configuration; or

• unauthorised modification after supply.

This provision does not exclude responsibility for a defect or safety issue that existed independently of the installation.

11. Inspection and Maintenance

Bicycle components are subject to wear, fatigue, vibration, impact, corrosion, environmental exposure and stress during normal use.

Customers should inspect and maintain their bicycle and components at appropriate intervals, taking account of frequency of use, riding conditions, rider weight, product materials and manufacturer recommendations.

Use must stop immediately if a component shows or develops:

• cracking or suspected cracking;

• deformation or impact damage;

• excessive wear or corrosion;

• looseness, movement or loss of fastener tension;

• unusual noise or abnormal operation; or

• any other indication that continued use may be unsafe.

A damaged or abnormal component must not be used again until it has been properly inspected and confirmed safe by a suitably qualified person.

Normal inspection and maintenance obligations do not relieve us, a manufacturer, an importer or another responsible party from liability for a defective or unsafe product.

12. Product Safety Reports and Incident Preservation

Anyone who experiences or becomes aware of a suspected product failure, defect, accident or safety concern should immediately stop using the affected product and contact Fantastic4toys.

Please provide, where available:

• the order number and product identification;

• a description of the incident and circumstances;

• clear photographs of the product, bicycle and affected area;

• installation and maintenance information;

• details of any earlier impact, damage, looseness or abnormal operation; and

• information about any injury or property damage.

The affected product, all separated pieces, associated components and relevant packaging should be retained in their current condition. They should not be cleaned, repaired, modified, discarded or subjected to destructive testing until the matter has been reviewed and suitable examination arrangements have been agreed.

Customers should not send a product involved in a safety incident until shipping and evidence-preservation arrangements have been confirmed.

We may request additional information reasonably necessary to investigate the incident, assess the product and comply with legal or regulatory obligations. We may also notify or cooperate with manufacturers, suppliers, insurers, carriers, testing specialists and competent authorities where appropriate and lawful.

13. Product Safety Measures and Recalls

If we reasonably believe that a product may present a safety risk, we may suspend sales, contact customers, request inspection, issue a safety notice, arrange repair or replacement, withdraw the product, conduct a recall, or take another appropriate corrective measure.

Customers should follow verified safety notices and recall instructions promptly.

Nothing in these Terms limits any legal obligation relating to product safety notifications, corrective actions, withdrawal or recall.

14. Defective Products and Legal Guarantees

Products are supplied subject to the warranties, guarantees and remedies required by applicable law.

If a product is defective, unsafe or materially inconsistent with its description, the customer should contact us with the order information and details of the issue.

Depending on the circumstances and applicable law, available remedies may include inspection, repair, replacement, refund, price reduction or another legally required remedy.

Any manufacturer’s warranty is additional to, and does not replace, mandatory rights against Fantastic4toys or another responsible party.

15. Website Availability and Errors

We do not guarantee that the website will always be uninterrupted, secure or free from technical error.

We may maintain, modify, suspend or discontinue website features where reasonably necessary. This does not affect rights or obligations arising from an order already accepted.

Occasionally, the website may contain an obvious typographical, technical, pricing or inventory error. We may correct such an error and, where it materially affects an unaccepted order, ask the customer to confirm the corrected order or cancel it and provide a refund.

Nothing in this section permits us to provide misleading product or safety information or to remove a mandatory consumer remedy.

16. Third-Party Links and Optional Tools

The website may contain links to third-party websites or provide access to third-party tools.

We do not control independent third-party websites and are not responsible for their availability, content or separate transactions. Customers should review the relevant third party’s terms and privacy practices before using those services.

This section does not apply to a product purchased directly from Fantastic4toys merely because that product was manufactured by a third party.

17. Reviews, Feedback and User Content

If you submit a product review, photograph, comment, suggestion or other content, you confirm that you have the right to submit it and that it does not unlawfully infringe another person’s intellectual property, privacy or other rights.

You grant Fantastic4toys a non-exclusive, worldwide, royalty-free licence to reproduce, display, translate and adapt submitted content for operating and promoting our business, subject to applicable privacy law.

We may moderate or remove content where reasonably necessary because it is unlawful, fraudulent, abusive, irrelevant, infringes another person’s rights, contains personal information, or threatens website security.

We will not knowingly alter a review in a way that materially misrepresents the reviewer’s opinion.

18. Intellectual Property

Unless otherwise stated, the website design, text, graphics, photographs, logos and original content owned by Fantastic4toys are protected by applicable intellectual property law.

You may use the website for personal, non-commercial shopping and reference. You must not reproduce, distribute, scrape, resell or commercially exploit our protected content without permission, except where permitted by law.

Third-party names and trademarks remain the property of their respective owners.

20. Disclaimer and Limitation of Liability

Nothing in these Terms excludes or limits:

• liability for death or personal injury where exclusion is prohibited;

• liability for a defective or unsafe product where exclusion is prohibited;

• fraud or fraudulent misrepresentation;

• wilful misconduct or gross negligence where applicable;

• a mandatory product warranty or legal guarantee;

• a consumer’s statutory rights or remedies; or

• any other liability that cannot lawfully be excluded or limited.

To the fullest extent permitted by applicable law, Fantastic4toys is not liable for indirect, incidental, special or consequential loss arising solely from website interruption, unauthorised customer misuse, or another matter for which exclusion is legally permitted.

Any exclusion or limitation applies only to the extent that the relevant loss was caused by the event or conduct described in that exclusion.

Nothing in these Terms limits the customer’s obligation to prove damage, defect, causation or loss where applicable law places that burden on the customer.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify Fantastic4toys against a third-party claim directly caused by your intentional unlawful use of the Services, infringement of a third party’s rights, fraudulent activity, or material breach of these Terms.

This provision does not require a consumer to indemnify us for our own negligence, breach, defective product, unlawful conduct or responsibility that cannot legally be transferred.

22. Events Outside Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control, including natural disaster, severe weather, war, civil disturbance, government restriction, customs disruption, carrier shutdown, widespread telecommunications failure or labour disruption.

We will take reasonable steps to reduce the effects of such an event and will comply with any cancellation, refund or delivery rights required by applicable law.

23. Suspension and Termination

A customer may stop using the website at any time.

We may suspend or terminate website access where reasonably necessary because of fraud, unlawful activity, security interference or material breach of these Terms.

Termination of website access does not cancel an accepted order, remove an accrued right, or eliminate an obligation that by its nature should continue.

24. Governing Law and Dispute Resolution

These Terms and any separate agreement through which we provide the Services are governed by the laws of Taiwan.

However, this choice of law does not deprive a consumer of any mandatory protection available under the laws of the consumer’s country or place of habitual residence.

The parties should first attempt to resolve a dispute by contacting each other in writing and exchanging the information reasonably necessary to understand the matter.

Nothing in these Terms restricts a consumer’s right to contact a consumer-protection authority, product-safety authority, alternative dispute-resolution body or any court having jurisdiction under applicable law.

25. Changes to These Terms

We may update these Terms to reflect changes in our Services, products, business practices or legal obligations.

Updated Terms will apply prospectively from publication unless applicable law requires otherwise.

A change will not retrospectively remove a right or remedy relating to an order placed before the change took effect.

Where a material change requires notice or consent under applicable law, we will provide that notice or obtain that consent.

26. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, it will be applied to the maximum extent legally permitted or severed where necessary.

The remaining provisions will continue to apply, provided that doing so does not create an unfair or unlawful result.

27. No Waiver

A delay or failure to enforce a provision does not constitute a permanent waiver of that provision or any other right.

28. Entire Agreement

These Terms, together with the policies and product-specific information expressly incorporated by reference, form the agreement governing use of the Services and purchases from Fantastic4toys.

They do not exclude any representation, warranty, consumer protection or other right that cannot lawfully be excluded.

These Terms will be interpreted fairly and in accordance with applicable consumer-protection law.
